RE: The tariff classification of a Press System from China

Dear Ms. Leonelli:

In your letter dated November 28, 2016 you requested a tariff classification ruling.

The machine being imported is called a press system that will be used to press very fine metallic powders into blocks also known as green blocks. The press system has an electronic control system and it uses hydraulic pressure along with a magnetic field in order to align the particles while they are being pressed. The hydraulics has a servo technique to control the speed and force of the main cylinders. The press is designed specially for pressing products made of neodymium iron boron (Nd-Fe-B). The NdFeB magnets being formed are of rectangular shape which requires a press area of not more than 80 x 150 mm.

The press system is capable of pressing green blocks of the following dimensions: 80 x 150 x 80 mm and 78 x79 x 40 mm. The tool is made of tungsten carbide (“WC”). The powder flows into the die cavity using a volumetric technique and a special feed tray for the volumetric die fill. The maximum powder flow rate is 2000g per fill.

The applicable subheading for the Press System will be 8462.91.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Machine tools (including presses) for working metal by forging, hammering or die-stamping; machine tools (including presses) for working metal by bending, folding, straightening, flattening, shearing, punching or notching; presses for working metal or metal carbides, not specified above: Other: Hydraulic Presses: Other. Other”. The rate of duty will be 4.4 per cent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
